Criminal Law Queensland - Established in 1928

The criminal justice system can be unwieldy and perplexing to the layman. There are different courts, which deal with different types of offences. There are many and varied procedures from arrest to being dealt with in a court.

The criminal justice process commences with an investigation by the investigating agency, whether it be the Queensland Police Service, The Australian Federal police or other government agencies such as the Australian Customers Service, The Australian Tax Office or any number of government departments that have investigative powers and responsibilities.

After the investigative process is complete and charges laid, the Court process begins through to a finding of guilt or an acquittal. Bail may need to be considered. Consideration needs to be given as to how best to handle your case depending on the nature of the charge.

There are now criminal sanctions in respect to work accidents, which can involve charges against employers. In many other areas governments have created new offences, which can affect every citizen.

In this ever-increasing complex society it is more important than ever that citizens rights are protected. The citizens must have the benefit of fearless independent advice when facing an investigation or charge by the police or any other government agency.

There is now legislation in both the federal and state spheres allowing a person's assets to be restrained and later forfeited. This can occur not only where such persons have been convicted of particular criminal offences but where no charge has been preferred. Such laws can also affect others who have done nothing more than to trust a relative, friend or loved one. Such legislation is relatively new to the law. It impacts upon citizens democratic rights.

If you find yourself the subject of a criminal investigation or have been arrested or charged or the subject of restraining orders made by courts in respect to your assets, you need to have the benefit of the advice of experienced legal practitioners who can defend your rights.

Our Mr O'Connor has been involved in the criminal law for over 30 years.
